The Professional Contractors Group-backed Dragonfly appeal was quashed at the High Court this week amid fears that a negative verdict could change the IR35 status of tens of thousands of contractors.
Still reeling from the news, the industry has yet to take in the implications of the High Court’s conclusion that Bessell’s IR35 defence was weak. As his defence relied on established IR35 tests, many are worried that HMRC has effectively been given the power to decide who is inside IR35, and who, if anyone, will be outside IR35.
